Confronting Severe OUI/DUI Penalties

Enacted in 2005, Melanie's Law is designed to increase the license suspensions and criminal punishments for Operating Under the Influence in Massachusetts. What Are the Effects of Melanie's Law?

Melanie's Law increased the severity of consequences for multiple OUI and DWI offenses. Four of the most severe consequences of the law are:

  • If you are pulled over for OUI while your license was already suspended because of a previous OUI, you can be charged with two crimes at once: OUI and "OUI with a suspended license".
  • No one is allowed to employ a person with a suspended license as a driver.
  • If you are pulled over with a passenger under the age of 14, you can be charged with OUI and "child endangerment while OUI."
  • An ignition interlock device must be installed on your vehicle, making the car inoperable unless you prove by Breathalyzer that you are not under the influence of alcohol.

In addition, if you refuse a breath test, your license will be suspended immediately and is added to any other license suspension that results from a DUI conviction. For example, if you refuse a breath test and you have one prior conviction, your license will be suspended for five years: three for the refusal and then two for the conviction.
