The Probate Process
Probating an estate takes place in the Probate and Family Court and follows procedures that depend on whether or not the decedent has left a will. The process begins when someone petitions the court to be appointed executor or administrator. Upon appointment, this person is charged with gathering and accounting for the deceased's assets, paying their lawful debts and expenses of administration and ensuring that assets are distributed according to the decedent's wishes.
With mandated timelines, the probating of an estate can take a year or longer. During that time issues often arise, involving matters such as:
- Payment of the decedent's debts
- Sale of real estate
- Sale of stocks or other assets
- Distributions to heirs
When a party makes a claim on estate assets, the dispute may be resolved through negotiation or mediation. If necessary, the court will conduct an evidentiary hearing and issue a judgment. Having a lawyer to guide you through this process is generally a good idea. I also handle other types of probate matters, including equity cases and unjust enrichment claims.
