Civil litigation is the process in which disputes lead to the filing of a lawsuit in court. One party files the lawsuit against another, and then the matter proceeds according to the Massachusetts Rules of Civil Procedure, and the applicable time standards and rules of the particular court.

Civil litigation encompasses many types of civil disputes including breach of contract cases and many others. My name is Stephen Dawley and I have been a Framingham civil litigation lawyer for many years and have experience handling both simple and complex cases. Milestones that arise in the course of most lawsuits include case management conferences, pretrial conferences, motions to dismiss, motions for summary judgment, and trial. While the case is ongoing, the parties engage in discovery, a process of gathering information that includes interrogatories, requests for admissions and depositions.  These are important parts of a case andI can help you with all of them.

Litigants are encourage to engage in alternative dispute resolution. This includes conciliation, mediation and arbitration. With alternative dispute resolution, or ADR, a third party, or neutral (a person with no stake in the case) listens to each party and makes a decision. This decision may or may not be binding depending on which form of ADR is chosen. Litigation is time-consuming and expensive. It is important to have an experienced attorney who knows how the court system works, who knows how to deal effectively with other lawyers, and who can offer sound well-reasoned advice regarding the available options.
